The exercise of the functions of the Lifetime Care and Support Authority and Lifetime Care and Support Advisory Council - Third Review

The Standing Committee on Law and Justice has an ongoing role to review the exercise of the functions of the Lifetime Care and Support Authority (LTCSA) of NSW and the Lifetime Care and Support Advisory Council (LTCSAC) of NSW. The LTCSA is the statutory authority responsible for the administration of the Lifetime Care and Support Scheme, which provides lifetime care and support to people severely injured in motor accidents in NSW. The LTCSA was established under the Motor Accidents (Lifetime Care and Support) Act 2006 on 1 July 2006. Section 68 of the Act provides that a committee of the Legislative Council is to be designated to supervise the exercise of the functions of the LTCSA and the LTCSAC. The Legislative Council appointed the Standing Committee on Law and Justice to undertake this role on 30 May 2007. The text of the resolution appointing the Committee is set out under the heading 'Inquiry Terms of Reference.' The terms of reference prevent the Committee from investigating individual participants or applications for participation in the Lifetime Care and Support Scheme. CURRENT REVIEW Please note that this review was conducted in conjunction with the Committee's Tenth Review of the Motor Accidents Authority.  The public submission phase for this review closed on 21 April 2010 and hearings were conducted on 11 and 21 June 2010. The Committee tabled its final report on 11 November 2010. The Government's response to the report's recommendations is due on 11 May 2011.
