I am advised:
(1) Doltone House submitted a Noise Management Plan (NMP) to the Department
of Planning and Environment on 20 December 2017 which did not meet the
requirements of the condition. The Department has reviewed the changes and on 2
February 2018, requested some further amendments be made.
(2) A revised NMP has not yet been submitted to the Department.
(3) On 27 November 2017, the Department issued an Official Caution and a
$6,000 Penalty Notice to Doltone House Wharf Pty Ltd (Doltone House) for
breaches that occurred on 16 October 2017. The Penalty Notice was issued for
failing to ensure deliveries are made within approved hours. The Official
Caution was issued for failing to ensure that all vehicles servicing the
facility use the loading bay facilities provided by the building and do not
unload material on the public domain.
On 6 March 2018, the Department issued a $6000 Penalty Notice to Doltone
House for failing to ensure deliveries are made within the approved hours on 29
November 2017.
The Department is currently engaged in on-going investigations into the
complaints received by the community.
(a) The outcomes from all investigations are communicated to the residents
who made the complaints. In addition to this, the Department publishes a
monthly Compliance Report, which gives a short summary of all enforcement
action taken during that month. These reports can be found at the following

(4) The Department has received 65 complaints about Doltone House since 1
November 2017 (until 14 March 2018).
(a) The majority of the 65 complaints are related to noise impacts. These
noise impacts are usually a result of either deliveries occurring outside of
approved hours or the operation of the function centre outside of approved
hours.
(5) The Department investigates every complaint received. As part of this
investigation process, the complainant will be contacted and will be kept
informed throughout the investigation process, including being contacted when
the investigation has been closed and being informed of the outcome.
The Department is currently engaged in on-going investigations into the
complaints received from the community.

(6) The Department takes the responsibility of regulating compliance with
conditions of consent very seriously and investigates all concerns raised by
members of the community. The Department is currently engaged in on-going
investigations into complaints received by the community. Once an investigation
has been undertaken, any breaches of the consent will be assessed against the
Department's Compliance Policy. Any enforcement action taken will be
communicated to the complainants and published in the monthly Compliance
report.
The Department has also undertaken unannounced surveillance of the site to
ensure conditions of approval are being complied with.
