(1) What is the total monetary value of civil litigation payments made by the New South Police Service for the following financial years:

(a) 2020 – 2021?

(b) 2019 – 2020?

(c) 2018 – 2019?

(d) 2017 – 2018?

(e) 2016 -2017?

(2) How many separate incidents are included in the above mentioned payments for the following financial years:

(a) 2020 – 2021?

(b) 2019 – 2020?

(c) 2018 – 2019?

(d) 2017 – 2018?

(e) 2016 -2017?

(3) In general terms what are the basic categories for which these payments are made?(for example – unlawful or inappropriate strip searches)

(a) What are the titles of those general basic categories?

(b) What payments were made to each category for the following financial years:

(i) 2020 – 2021?

(ii) 2019 – 2020?

(iii) 2018 – 2019?

(iv) 2017 – 2018?

(v) 2016 -2017?

(c) How many incidents fell into each category for the following financial years:

Answer -

I am advised:

(1) The below figures only include claims brought by those eligible to sue at common law, rather than those through workers compensation legislation, and for claims of historical sexual assault. The figures also include multi-agency matters, but only the NSW Police Force contribution.

(3) Payments cover civil claims brought against the NSW Police Force by way of Statement of Claim or Letter of Demand for assault, battery, unlawful imprisonment, malicious prosecution, breach of statutory duty, conversion, intimidation, injurious falsehood, collateral abuse of process, negligence, trespass and misfeasance in public office. Torts are not broken down into categories.

NSW Police Force systems only record payments for the whole claim and are not broken down into individual torts or categories. The number of incidents for each tort or category is also not recorded.

(4) Claim costs, including legal costs spent defending the agency are covered by the NSW Police Force insurer. The NSW Police Force only has access to the total cost for claims, it is not broken down into categories such as those for legal representation.
