(2) Has icare’s board agreed to any key performance indicators (“KPIs”) with the icare Choef Executive Officer (CEO)?

(i) Please see Tab A. It should be noted that some metrics require baseline results from new surveys that have been deployed and are awaiting results.

(ii) The KPIs cover an 18-month period inclusive of FY22. Outcomes will not be known until then.

(iii) The Board discusses the CEO’s performance on a regular basis. A formal discussion and assessment of the CEO’s performance against his KPIs will be conducted by the Board at the end of the performance year, following finalisation of results.

(iv) See response to 2 (a)(iii).

(iii) The CEO provides feedback to the Group Executive, Workers Compensation on her performance on a regular basis. An informal review and performance discussion will take place mid-year, followed by a formal discussion and assessment of performance that will take place at the end of the performance year, following finalisation of results.

(5) In August 2020, the icare Board instructed icare management that the Workers Compensation Nominal Insurer exemption, to part 11 of the Public Works and Procurement Act 1912, per section 154a(4) of the Workers Compensation Act 1987, may no longer be utilised to procure goods and services unless the express authorisation of the Board is obtained, and only in exceptional circumstances.

  This position was formalised in icare’s Procurement Policy in November 2020 and in icare’s Procurement Approvals Framework in July 2021. Noting this, there have been nine instances where the Board approved contracts under the NI exemption for the period of September 2020 - 20 September 2021. The majority of these have been for the purposes of extending existing contracts that exist for the purposes of enabling time to remediate with a fully compliant RFP at a later date.

 All active contracts, including those that were previously listed with a zero total value, are listed on the NSW eTendering website in line with requirements under the Government Information (Public Access) Act 2009.
