2168 - Planning - PROPOSAL TO AMEND SUTHERLAND SHIRE LOCAL ENVIRONMENTAL PLAN 2015

I refer to the proposal that seeks to amend Sutherland Shire Local Environmental Plan 2015 to increase the maximum building height and floor space ratio for 10-14 Merton Street, Sutherland.:

  1. Is the Minister aware that the Development Application (DA) has been knocked back twice and the Department of Planning is now using public money to employ an Independent Consultant to assist the Developer through the Gateway Process?
  2. Does the Minister support the use of public money to employ an Independent Consultant to assist a Developer through the Gateway Process?
Answer -

I am advised:

  1. A development application for residential flat buildings on the site was refused by Sutherland Shire Council in 2003 under the Sutherland Shire Local Environmental Plan 2000. The controls for the site were reviewed and updated in the Sutherland Shire Local Environmental Plan 2015. Council has since approved two development applications for residential flat buildings on the site – in 2016 for 10 Merton Street, and in 2017 for 12-14 Merton Street.
  2. The Environmental Planning and Assessment Regulation 2000 enables the Department of Planning and Environment to recover costs incurred as part of the rezoning review process from the proponent. The proponent has been invoiced for the full cost of this work.
