1017 - REMOVAL OF ASBESTOS

Hoenig, Ron to the Minister for the Environment, Minister for Heritage, and Assistant Minister for Planning
  1. Is the Alexandria Landfill site subject to a New South Wales Environmental Protection Agency (EPA) clean up notice, particularly for the removal of asbestos?
  2. Has the EPA issued a licence to the WestConnex Delivery Authority to remove asbestos from the Alexandria tip site?
  3. Were the remedial works to remove asbestos at the Alexandria tip site undertaken on or after 12 August 2015 completed under a valid EPA licence?
    1. If so, when were the licences issued by the EPA?
Answer -

I am advised as follows:

  1. A clean up notice was issued to the previous occupier of the site for the safe removal of a specific stockpile. WestConnex Delivery Authority took over ownership of the site prior to the works being completed. The EPA is currently finalising a new clean up notice to WestConnex Delivery Authority to require it to complete the works.
  2. and (3) The removal of asbestos waste does not require an environment protection licence as a scheduled activity under Schedule 1 of the Protection of the Environment Operations Act 1997.
    The transport and disposal of asbestos waste must be undertaken in accordance with clauses 77 to 81 of the Protection of the Environment Operation (Waste) Regulation 2014.
