  1. What functions and what staff were transferred from the WestConnex Delivery Authority (WDA) to the Sydney Motorway Corporation (SMC) and on what date this occurred?
    1. How are these bodies different?
  2. What is the composition of the SMC and what fees are paid to the Directors?
  3. Did the transfer of functions from the WDA to the SMC occurred because the planning phase of the WestConnex project was over?
    1. If so, how is this possible considering that no planning approvals have been granted for Stages 1, 2, or 3 and no Environmental Impact Statement has been provided for Stage 2 and 3?
  4. What is the precise relationship between the Roads and Maritime Services (RMS) and the SMC which is a publicly owned private corporation?
  5. Will the SMC publish annual reports and will the financial accounts be publicly available?
  6. Is the SMC subject to the GIPA Act?
  7. What WestConnex contracts will be let by the RMS and what contracts will be let by the SMS?
Answer -

I am advised:

(1) to (5) and (7) The WestConnex Delivery Authority (WDA) was dissolved on 1 October 2015. The WDA was a public subsidiary corporation of Roads and Maritime Services (RMS) constituted in accordance with section 55C of the Transport Administration Act 1988. Sydney Motorway Corporation Ply Ltd (SMC) and its subsidiaries are corporations registered under the Corporations Act 2001. Further information on the relationship between RMS, SMC and WDA is available on the WestConnex website.

The SMC is responsible for delivery of the WestConnex scope of works for stages one, two and three. RMS and Transport for NSW are responsible for broader network integration property acquisition, planning approvals and guiding the update of the business case.
