SMOKING BANS IN NEW SOUTH WALES

(1) How many complaints in each of the last three years has NSW Health received about a location or person (including a business or retailer) in the Pittwater electorate regarding the breaking of an indoor or outdoor smoking ban?

(a) Please provide a breakdown of the number of each type of complaint in each of the last three years.

(2) How many complaints in each of the last three years has NSW Health received about a location, premises, or person (including a business or retailer) in the Pittwater electorate regarding a tobacco or e-cigarette retail law being broken?

(a) Please provide a breakdown of the number of each type of complaint in each of the last three years.

(3) How many fines have been issued to retailers, persons (including a business or retailer) or premises under the Public Health (Tobacco) Act 2008 and / or the Public Health (Tobacco) Regulation 2022 in the Pittwater electorate in each of the last three years?

(a) Please provide a breakdown of the number of each type of fine and the overall amount fined in respect of each fine in each of the last three years.

(4) Currently, how many inspectors (as defined in section 7A of the Public Health (Tobacco) Act 2008) are there in New South Wales?

(5) On how many occasions in each of the past three years have inspectors made visits to tobacco or e-cigarette retailers in the Pittwater electorate?

(a) How many of those visits were random?

(b) How many of those visits were pre-arranged?

(6) What is the Government’s policy or plan to eliminate the harm being caused on young people owing the sale of e-cigarettes (whether or not such devices contain nicotine)?

SMOKING BANS IN NEW SOUTH WALES

(1 – 3) and (5)

NSW Health does not collect data on compliance and monitoring activities on an electorate basis.

(4) The NSW Ministry of Health employs inspectors who are authorised to conduct compliance work under the Public Health (Tobacco) Act 2008.

The numbers of inspectors authorised by Local Health Districts will vary.

(6) The NSW Government aims to protect young people from the health harms of vaping, including through regulation and compliance, stakeholder engagement, education and communications, research, and clinical engagement.

NSW Health has an active and comprehensive tobacco and e-cigarette compliance program, which includes enforcing bans on the sale of e-cigarette and tobacco products to people under the age of 18. Data on seizures of illegal nicotine can be found on NSW Health's website.
