Heritage law in NSW is the product of international treaties, Commonwealth and State legislation, and local Government regulations. There is an ongoing process of review of the system for heritage management in NSW and this is reflected in the various amendments to the Heritage Act, the Environmental Planning and Assessment Act and the enactment of the new Local Government Act.

This Briefing Paper aims to clarify the legal position concerning heritage in New South Wales and points out the practical limitations and consequences of various heritage laws and controls. It is divided into 3 main parts and examines the concept of heritage, heritage law, and issues in heritage management.
