of delivery and waste removal conditions, numbers and behaviour of patrons and
hours of operation have been made since 2011 (to 24 October 2018)?

- How many resulted in enforcement action;
- What action was taken?
- What proactive action has the Government taken to prevent future impacts
and ensure compliance with consent conditions?
- What further action will the Government take to ensure compliance and
protect adjacent residents from intrusive night time noise and nuisance?

I am advised:
- A draft Noise Management Plan (NMP) has been submitted to the Department
for approval.
- The assessment of the NMP has involved seeking additional information from
Doltone House to ensure that the plan meets the conditions of consent.
- The Department is assessing the NMP and as such it would not be appropriate
to release it publicly at this stage. There is no requirement under the Doltone
House consent for the NMP to be made publicly available once approved.
- Since 2014, the Department has received approximately 230 complaints, and
of these complaints 159 are from one complainant.
- The Department investigates all concerns raised by the community.

In November 2016, the Department issued Doltone House with an Official
Caution. Since June 2017, the Department has issued Doltone House with four
Penalty Notices (three for out of hours deliveries and one for exceeding patron
numbers) and three Official Cautions for breaches of their Consent DA
52-03-05.

The Department has requested Doltone House better address residents'
concerns, including through completing a revised NMP. The Department has also
recommended to Doltone House that they meet with affected residents to discuss
their concerns and attempt to resolve them. The Department has offered to
attend this meeting and provide a facilitator.

The Department will continue to monitor the development and investigate any
concerns raised by the community from time to time.
