Expulsion

254. A Member adjudged by the House guilty of conduct unworthy of a Member of Parliament may be expelled by vote of the House, and the Member's seat declared vacant.

1998 Precedent1. The Leader of the Opposition moved, pursuant to notice: (1) That in view of the determination of the Independent Commission Against Corruption that Brian Joseph Langton: (a) is guilty of corrupt conduct; (b) has dishonestly exercised his official functions as a Member of Parliament; (c) has obtained a personal financial advantage from taxpayer funds “knowingly, deliberately, wilfully, repeatedly, and in circumstances of bad faith”; and (d) has engaged in conduct which is “contrary to the faith, edict and trust of mankind”, this House determines that Brian Joseph Langton be adjudged guilty of conduct unworthy of a Member of the Legislative Assembly; and (2) That Brian Joseph Langton be expelled by this House and his seat in the Legislative Assembly be declared vacant. S.O. 296 of 1994 (Repealed)296. The same rules of disorder apply in Committee as in the House except that disorder in Committee can only be censured by the House receiving a report. The Speaker may resume the Chair in cases of sudden disorder.
