*4046 HUNTER GAS USERS GROUP—Mr Pringle to Minister for Regional Development, Minister for the Illawarra, and Minister for Small Business—

Does the Minister propose to support the Hunter Gas Users Group with respect to gas usage charges which appear to be considerably higher for the manufacturing industry in the Hunter than Sydney?

Answer—

I am advised that no approach has been made to me on this issue by this Group or the Member for Hawkesbury. I would be pleased to received further information on their concerns.

*4047 EDUCATION HOSPITALITY KITCHENS—Mr Pringle to Minister for Transport, representing the Minister for Education and Training—

When will the much needed upgrade of the Vocational Education/Hospitality kitchen classrooms at Richmond High School commence?

Answer—

I am advised that an upgrade to the food technology spaces at Richmond High School will be considered in the context of competing regional priorities. An indication of the funding and time frame for the inclusion of the project in a forward program cannot be provided, as it is not possible to pre-empt the deliberations of the Budget Committee in the formulation of the annual State Budget.

*4048 ROUSE HILL DISTRICT HIGH SCHOOL—Mr Pringle to Minister for Transport, representing the Minister for Education and Training—

When does the Minister anticipate construction will begin on a new high school for the Rouse Hill district?

Answer—

Two new high schools have been opened in the Rouse Hill and nearby area; Kellyville High School in 2003 and Glenwood High School at the beginning of 2005.
I am advised that the Department of Education and Training has recognised the need for a future high school in this growth area and a site has been identified in the Rouse Hill Regional Centre development.
The timing of a new high school in Rouse Hill will be dependent on the staging of development in the Rouse Hill Regional Centre together with enrolment demand in the existing high schools. Development in this area will continue to be monitored.
A definite timetable for a new high school at Rouse Hill cannot be given at this stage. In the meantime, students in the north-west sector of Sydney will be well served by existing high schools.





*4050 BUS SERVICE REPLACING TRAINS—Ms Seaton to Minister for Transport—

Will buses be provided to replace weekend rail services between Moss Vale and Goulburn which were discontinued in the proposed September 2005 timetable changes?
Answer—

As I announced on May 10, yes.

*4051 BOWRAL DEPARTMENT OF COMMUNITY SERVICES—Ms Seaton to Minister for Community Services, and Minister for Youth—

(1) How many “child at risk of harm” notifications were lodged
(a) directly to the Bowral Community Services Centre
(b) indirectly to the Helpline of the Bowral Community Services Centre in each month in each of the last 3 years?
(2) How many of such notifications were allocated and how many were closed without complete investigation?

Answer—

(1) The DoCS Helpline was introduced in December 2000 as the single entry point for all people wanting to report child protection issues. The Helpline is the first point of contact for enquiries, reports and requests for assistance, rather than individual Community Services Centres. The single Helpline provides a consistent intake system across NSW, screening all matters and applying risk assessment processes to reports where a child or young person is at risk of harm.
Risk of harm reports are only taken at CSCs in exceptional circumstances This helps allow caseworkers in individual Community Services Centres to concentrate on frontline service delivery. The Bowral Community Services Centre does not have its own Helpline.
(2) Information about secondary assessments/investigations is not currently available. It is anticipated this data will be available later this year.

*4052 DARCY ROAD INTERSECTION—Ms Allan to Deputy Premier, Treasurer, Minister for State Development, and Minister for Aboriginal Affairs, representing the Minister for Roads, Minister for Economic Reform, Minister for Ports and Minister for the Hunter—

(1) How many serious accidents have occurred at the intersection of Cumberland Highway and Darcy Road, Wentworthville in the last five years?
(2) What does the Roads and Traffic Authority propose to improve this intersection?

Answer—

I’m advised:
The specific information the Member has requested is not available. However information relating to traffic crash statistics is provided annually by the RTA in the publication, Road Traffic Crashes in NSW, which is publicly available on the RTA website at www.rta.nsw.gov.au.
As announced by the Premier in April 2005, the Westlink M7 Motorway is expected to open ahead of the scheduled completion date of August 2006. The opening of the M7 will see the redistribution of traffic in this area including an associated reduction in traffic on the Cumberland Highway.
The RTA will monitor traffic movements at this intersection following the opening of the M7 for any necessary improvements.




*4053 ROADS AND TRAFFIC AUTHORITY INTERSECTION PLANS—Ms Allan to Deputy Premier, Treasurer, Minister for State Development, and Minister for Aboriginal Affairs, representing the Minister for Roads, Minister for Economic Reform, Minister for Ports and Minister for the Hunter—

(1) What is the Roads and Traffic Authority’s plan for the intersection of the Cumberland Highway and the Great Western Highway at Wentworthville?
(2) When will these plans be implemented?
Answer—

I’m advised:
Since 2001, the NSW Government has spent more than $680,000 to provide the following improvements at the intersection of the Cumberland Highway and the Great Western Highway:
? upgrade works including the installation of mast arm posts providing traffic lights allowing for the removal of the median posts for the Great Western Highway approaches;
? realignment of the left turns from the Great Western Highway into the Cumberland Highway from slip lanes to high angle entry left turns requiring motorists to reduce speed; and
? resurfacing of the intersection to provide skid resistant treatment.

*4054 ABORIGINAL LAND CLAIMS —Mr Crittenden to Minister for Regional Development, Minister for the Illawarra, and Minister for Small Business, representing the Minister for Rural Affairs, Minister for Local Government, Minister for Emergency Services and Minister for Lands—

(1) How many Aboriginal Land claims under the Aboriginal Land Rights Act 1983, that would normally be processed at the Maitland office of the Department of Lands in the first instance, were lodged prior to Aboriginal Land Claim 6577 on 9 April 2001?
(2) How many of these claims lodged prior to Claim 6577 are still with the Maitland Lands Office and have not progressed to the Sydney office of the Department of Lands as at 5 May 2005?
(3) How many Aboriginal Land claims under the Aboriginal Land Rights Act 1983, that would normally be processed at the Maitland office of the Department of Lands in the first instance, were lodged after Aboriginal Land Claim 6577 on 9 April 2001 until and including 9 April 2004?
(4) Has any agent, employee, associate or Director of the Terrace Tower Group and/or its subsidiary Kalayla Pty Ltd contacted the Maitland Office of the Department of Lands and communicated through written, verbal or electronic means with any officer in that office in respect of Aboriginal Land Claim 6577? If so, on how many occasions has this occurred and what are the relevant dates?
(5) Has any agent, employee, associate or Director of the Terrace Tower Group and/or its subsidiary Kalayla Pty Ltd contacted the Maitland Office of the Department of Lands and communicated through written, verbal or electronic means with any officer in that office in respect of Aboriginal Land Claim 6577 and sought to have Aboriginal Land Claim 6577 expedited?
(6) Are Aboriginal Land Claims under the Aboriginal Land Rights Act 1983 processed at the Maitland office of the Department of Lands in the order of receipt? If not, why not?
(7) Have all Aboriginal Land Claims under the Aboriginal Land Rights Act 1983 processed at the Maitland office of the Department of Lands been processed in the order of receipt for the entire period covering the previous two years?
(8) Is it true that Aboriginal Land Claim 6577 under the Aboriginal Land Claims Act 1983 is being given a higher priority than other Aboriginal Land Claims under the Aboriginal Land Claims Act 1983 including those received prior to Aboriginal Land Claim 6577 at the Maitland office of the Department of Lands?
(9) Has the Minister or any officer of the Department of Lands been made aware that a development contract between Belmont Golf Club Limited and Kalayla Pty Ltd is predicated on acquisition of land that is the subject of Aboriginal Land Claim 6577?
(10) Has the Minister or any officer of the Department of Lands been made aware that there is a time constraint contained in the development contract between Belmont Golf Club Limited and Kalayla Pty Ltd whereby land acquisition and relevant approvals have to be achieved on or before 19 July 2006?
(11) Is Aboriginal Land Claim 6577 being expedited due to pressure from sources within the State Government or because of private sector pressure?
(12) If not, what is the basis for expediting Aboriginal Land Claim 6577 ahead of other claims lodged earlier and why have they not been processed in chronological order?

Answer—

I am advised:
(1) 967.
(2) 7.
(3) 216.
(4) No.
(5) No.
(6) All claims received at the Maitland office are dealt with in order of receipt during the initial stages of investigation and referencing. Timing of completion however, depends on a number of factors, including complexity of the case in terms of land status and usage history, timing and content of responses to referencing, the number and nature of stakeholders involved and the nature of information required to be collated to finalise the local investigation report. Very simple claims will be finalised well prior to complex cases, regardless of the order of receipt. Staff will also be dealing with a number of claims concurrently.
(7) As above.
(8) No.
(9) to (10) Yes, staff of the Maitland Office were contacted by a member of the Golf Club and were advised that there was a contract between the Golf Club and a prospective developer and that there was a time frame in place between the two. The provision of this information has had no influence whatsoever on the assessment of the claim.
(11) No.
(12) Processing of the claim has occurred in due order.

*4055 TERRACE TOWER GROUP—Mr Crittenden to Minister for Energy and Utilities, Minister for Science and Medical Research, Minister Assisting the Minister for Health (Cancer), and Minister Assisting the Premier on the Arts—

(1) Has any agent, employee, associate or Director of the Terrace Tower Group and/or its subsidiary Kalayla Pty Ltd communicated with any officer of Hunter Water either in writing, verbally or electronically concerning access to or acquisition of land or facilities presently in the care, control or ownership of Hunter Water near or adjacent to Belmont Golf Club?
(2) Who are the officers or employees with whom the agent, employee, associate or Director of the Terrace Tower Group or its subsidiary, Kalayla Pty Ltd have met?
(3) Is there a Memorandum of Understanding in place between the Terrace Tower Group including its subsidiary Kalayla Pty Ltd and Hunter Water in respect of land or facilities near or adjacent to Belmont Golf Club?
(4) If so, what is the basis of this Memorandum of Understanding? If not, are communications occurring with a view to achieving a Memorandum of Understanding?
(5) Has any officer or employee of Hunter Water been made aware that a development contract between Belmont Golf Club Limited and Kalayla Pty Ltd is predicated on acquisition of land that is the subject of Aboriginal Land Claim 6577 ?

Answer—

(1) to (6) I am advised that:
The contract between Belmont Golf Club and Kalayla Ltd, a subsidiary of Terrace Tower Group, is a private contract.
There is an Aboriginal land claim on part of the land involved in this contract, Aboriginal Land Claim 6577.
Processing of this claim has occurred in due order. All Aboriginal land claims are treated in the same manner and are based on their merits.
I am not aware of any Memorandums of Understanding existing between Hunter Water and Terrace Group in respect to this matter.

*4057 ACCESS/ACQUISITION OF LAND/FACILITIES—Mr Crittenden to Minister for Regional Development, Minister for the Illawarra, and Minister for Small Business, representing the Minister for Rural Affairs, Minister for Local Government, Minister for Emergency Services and Minister for Lands—

(1) Has any agent, employee, associate or Director of the Terrace Tower Group and/or its subsidiary Kalayla Pty Ltd communicated with any officer or employee of Lake Macquarie City Council either written, verbally or electronically concerning access to or acquisition of land or facilities presently in the care, control or ownership of Lake Macquarie City Council near or adjacent to Belmont Golf Club?
(2) Who are the officers or employees with whom the agent, employee, associate or Director of the Terrace Tower Group or its subsidiary, Kalayla Pty Ltd have communicated?
(3) Is there a Memorandum of Understanding in place between the Terrace Tower Group including its subsidiary Kalayla Pty Ltd and Lake Macquarie City Council in respect of land or facilities near or adjacent to Belmont Golf Club?
(4) If so, what is the basis of this Memorandum of Understanding? If not, are communications occurring with a view to achieving a Memorandum of Understanding?

*4059 BELMONT GOLF CLUB ASSETS—Mr Crittenden to Deputy Premier, Treasurer, Minister for State Development, and Minister for Aboriginal Affairs, representing the Minister for Roads, Minister for Economic Reform, Minister for Ports and Minister for the Hunter—

(1) Have you or any officers of your administration had any communications with any agent, employee, associate or Director of the Terrace Tower Group including its subsidiary Kalayla Pty Ltd in respect of any matters pertaining to Belmont Golf Club Limited or anything that may affect the assets of Belmont Golf Club?
(2) Notwithstanding the generality of the foregoing in (1) above, have any Members of State Parliament or anyone else made representations or sought your assistance or advice to expedite this matter?

Answer—

The Terrace Tower Group briefed me on their Hunter projects prior to becoming Roads Minister in my capacity as Minister for the Hunter.





*4060 REGISTERED CLUB INDUSTRY—Mr Crittenden to Minister for Gaming and Racing, and Minister for the Central Coast—

(1) Have you given undertakings that in considering a twenty year plan for the registered club industry, you as Minister would look at a range of issues, including how community assets in relation to registered clubs’ real property may be protected (AFR April 22-25, 2005)?
(2) Did your second reading speech on the Registered Clubs Amendment Bill specifically recognise that there is a trend whereby private entrepreneurs have sought to gain control over a club's management and operations, obtaining significant financial benefits and in some cases ownership of the club's assets (14 November 2003)?
(3) Why therefore did you allow the Director-General of your Department to produce “guidelines” for clubs that circumvented the Section 41J amendments contained in the Registered Clubs Amendment Bill?
(4) Why were these “guidelines” not referred to in the Registered Clubs Amendment Bill, Regulations or your second reading speech?
(5) What have, or are, you doing to ensure that these “guidelines” do not subvert the intention of the legislation?

Answer—

(1) Over the past 12 months, two Ministerial Advisory Bodies, the Club Industry Task Force and the Special Ministerial Advisory Group, have discussed a wide range of issues relating to the future development of the Registered Club Industry in New South Wales.
(2) The speech explained how the bill provided for changes that will prevent the disposal of major assets without a majority resolution of all members.
(3) No guidelines have been produced by the Director-General of the Department of Gaming and Racing.
Guidelines have been prepared by the Director of Liquor and Gaming. The Director of Liquor and Gaming is a statutory officer located within the Department, and appointed by the Governor with powers, responsibilities and obligations under the Registered Clubs Act 1976.
(4) to (5) The Director of Liquor and Gaming has advised me that the guidelines only applied to agreements entered into for the disposal of land prior to the commencement date of the legislation and that since that date all clubs are required to strictly comply with the legislation.

*4061 LOCKED TRAIN DOORS—Mr Debnam to Minister for Transport—

In relation to locked train doors:
(1) Did Justice McInerney recommend in January 2005 that the RailCorp passenger containment policy must be abandoned?
(2) Did the Independent Transport Safety and Reliability Regulator recommend in November 2004 that train doors should be provided with an internal door opening device that permits passengers to escape in a serious situation?
(3) Did the Independent Transport Safety Reliability Regulator note in November 2004:
(a) the panel covering the Emergency Door Release (EDR) on the outside of carriages device has no identifying feature to indicate it is a piece of emergency equipment;
(b) at the Waterfall crash one city rail staff member found that the EDR failed to open the door; and
(c) the rate of frequency of fires occurring on the State Rail network is twice that of the rate that occurs on the rail network of the UK?
(4) Did the June 2001 Christie Report note that there were serious shortcomings in fire and life safety systems for the underground portions of the rail network and that current risks were above acceptable limits?
(5) Are you aware Government safety audits note that fires and explosions in CityRail have increased dramatically in the last two years with January being the worst month to date with 21 fires and explosions in CityRail?
(6) Will you act urgently to ensure that these changes are enacted to allow train passengers to escape rail carriages in the event of a fire?

Answer—

The Ministry of Transport advises:
(1) The final report of the Special Commission of Inquiry into the Waterfall Accident is available on ITSRR’s website at www.transportregulator.nsw.gov.au.
(2) to (3) ITSRR’s report entitled Train Door Emergency Egress and Access and Emergency Evacuation Procedures was released in November 2004 and is available on the ITSRR website www.transportregulator.nsw.gov.au.
(4) The Christie Report was tabled in Parliament in 2002, and is available from the parliamentary library.
(5) Information on safety incidents is available on the RailCorp website at www.cityrail.info.
(6) Progress on the implementation of recommendations contained within the final report of the Special Commission of Inquiry into the Waterfall Accident is available on ITSRR’s website at www.transportregulator.nsw.gov.au.

*4062 WATERFALL RECOMMENDATIONS—Mr Debnam to Minister for Transport—

In relation to the implementation of Waterfall recommendations:
(1) When is the Independent Transport Safety and Reliability Regulator’s (ITSRR) first quarterly report ‘on the progress made by RailCorp on the implementation of the [Waterfall] Commission’s recommendations’ scheduled to be delivered to your office?
(2) Will you release the report immediately upon its receipt and if not, when will you release the report?

Answer—

(1) to (2) ITSSR’s first quarterly report on the implementation of the Government’s response to the recommendations contained within the Final Report of the Special Commission of Inquiry into the Waterfall Accident was tabled in this house on 10 May 2005.
The first quarterly report has also been published on the ITSRR website.

*4064 TICKET PRICES—Mrs Hopwood to Minister for Transport—

In relation to prices as at 1 September in each of the years 2000, 2001, 2002, 2003 and 2004:
(1) What was the price of a return train fare from Berowra (via North Shore line) to Central Station from Hornsby (via North Shore line) to Central Station?
(2) What was the price of a return train fare from Hornsby (via the main North line) to Central Station?

Answer—

RailCorp advises:
(1) and (2) Ticket Price is determined by the time of day the ticket is purchase and whether the purchaser is entitled to a concession.

*4065 TRAIN FREQUENCY—Mrs Hopwood to Minister for Transport—

Over a 24 hour period for the months of February and March 2005 how many:
(1) Freight trains passed through Hornsby Station going north and south?
(2) XPT (intercity) trains passed through Hornsby Station going north and south?



Answer—

RailCorp advises:
(1) An average of 18 freight trains passed through Hornsby each day during February 2005. An average of 17 freight trains passed through Hornsby each day during March 2005.
(2) There are eight XPT/Explorer train movements through Hornsby each weekday.

*4066 RURAL FIRE SERVICE VOLUNTEERS—Mrs Hopwood to Minister for Police, representing the Minister for Rural Affairs, Minister for Local Government, Minister for Emergency Services and Minister for Lands—

(1) How many unpaid volunteers working for the Rural Fire Service are there in the Hornsby electorate?
(2) How many paid workers are there for the same area?

Answer—

(1) 590.
(2) 14 staff that provide support not only to volunteers within the Hornsby electorate but also to volunteers from a number of other Brigades that do not fall within Hornsby electoral boundary.

*4068 TRANSPORT MANAGEMENT PLAN—Mr Constance to Minister for Transport—

(1) Is there a transport management plan for south east New South Wales?
(2) What transport infrastructure plans are in place for the south east region of New South Wales?

Answer—

The Ministry of Transport advises:
(1) and (2) This matter falls within the administration of the Hon Craig Knowles, Minister for Infrastructure, Planning and Natural Resources. This matter should be referred accordingly.

With respect to each Department of Community Services (DoCS) region in New South Wales:
(1) How many category 1 reports to DoCS officers have been closed without a caseworker visiting the child or young person reported for each month in 2003, 2004 and 2005?
(2) Why were files closed without adequate investigation?

Answer—

(1) to (2) The Information requested is not collected in this form.

Answer—

I provide the following details in response to your questions:
(1) The Local Government Act 1993 provides that annual rates and charges may be paid in a single instalment or by quarterly instalments. Section 564 of the Act allows a council to accept payment of rates and charges by a different number of instalments. However, for rates to be paid by more than four instalments an agreement must be made between the Council and the individual ratepayer before this may occur.
(2) The Local Government Act 1993 does not prevent either the council or the individual ratepayer from initiating an agreement to pay annual rates and charges in a manner that differs from those prescribed by section 562 of the Act (either in full or by four quarterly instalments). The provision exists to facilitate payment of rates, in particular where a ratepayer may be unaware of the provision and it is the council that suggests the arrangement.

The road corridor providing for an extension of the F6 has been in place since 1951.
The metropolitan road network, including the F6 proposal, is currently being reviewed as part of the Government’s roads infrastructure plan and future planning for the metropolitan area.
The RTA has been asked to ensure the corridor continue to be maintained to sufficient capacity for possible future transport and road development.

MOST has been working closely with other Government agencies and Local Government in developing its approach to open space planning and acquisition.

(1) Is the Government aware that three quarters of NSW Supported Accommodation Program (SAAP) funded services face viability problems because operating costs have increased while real funding has declined over the past 10 years?
(2) Is the Government aware that SAAP funded services turn away more than 40% of those who are seeking emergency accommodation?
(3) What action will the Government take to provide the 15% funding boost estimated by the evaluation of the Commonwealth Department of Family and Community Services as necessary to maintain existing services?
(4) How will the Government ensure that emergency accommodation services are not forced to close or reduce services?

Answer—

(1) to (4) The NSW Government recognises the importance of SAAP services in preventing and addressing homelessness in NSW.
Under the current program, SAAP funding is provided to around 400 NSW community services that support more than 25,000 people each year who are homeless or at risk of homelessness.
NSW is the only state which contributes more funding than the Commonwealth i.e. more than 50 percent, and more than required under the terms of the current Agreement, as well as funding additional state programs.
Urgent consultations are underway with the SAAP sector to determine the likely impact of the recent offer by the Federal Government. Concerns have been expressed that the Federal Government’s offer threatens the very existence of some of these services.
NSW increased funding under SAAP IV and will maintain that increased level throughout SAAP V.
NSW will support extending the current Agreement until 30 September 2005 to provide services with funding certainty during this time.
I will continue to push for the best possible outcomes for these services in NSW.

(1) I am advised by Sydney Water that a draft subdivision and Masterplan have been developed in consultation with the community, including the City of Sydney. Pre-Development Application material was submitted to the City of Sydney in November 2004. The City of Sydney issued its comments in March 2005. The material is now with the Heritage Office for consideration. The subdivision Development Application and Masterplan will be submitted to the City of Sydney following consideration by the Heritage Office.
(2) Sydney Water has also advised that further opportunities for public comment will occur when the Masterplan is lodged with the City of Sydney as part of the subdivision Development Application.

“Insofar as compliance with section 41J of the Act is concerned, it has been established that the actions of the Club fall within guidelines issued to address situations where negotiations for the disposal of land have been entered into prior to the commencement of new legislation. In this regard, as negotiations involving the development commenced prior to 10 December 2003, the Club is not captured by the provisions of Section 41J of the Act.”?
(2) Did Mr KM Brown, the Director of Liquor and Gaming, on 17th November 2004, in a letter to the solicitors TD Kelly & Co. concerning Belmont Golf Club, acting for the Member for Wyong, state in paragraph 10 the following:
“It is unfortunate that the wording in the last sentence of paragraph 3 of Mr Loewenthal’s letter to Mr Crittenden dated 10 November 2004 seems to suggest that the Club need not comply with Section 41J for this was not the intention. The Club is required to comply with Section 41J but in the event it doesn’t and provided it falls within my guidelines, and provided the disposal has generally been for the benefit of members of the Club and has been supported by the members, I would not anticipate taking any proceedings for a breach of that section.”?
(3) Did you sign a letter to the Member for Swansea dated 10 November 2004 which contained exactly the same paragraph 3 as that contained in Mr Loewenthal’s letter to the Member for Wyong dated 10th November 2004? When did you become aware that paragraph 3 was erroneous and could mislead the Member for Swansea? Did you take any action to clarify your comments to the Member for Swansea?
(4) Was a letter sent from the Department of Gaming and Racing or yourself to the Belmont Golf Club dated 10 November 2004 which in part states as follows:
“I am of the view that negotiations involving the development commenced prior to 10 December 2003 and as a result the disposal of club land detailed within the negotiations is not captured by the provisions of Section 41(J) of the Act.”?
(5) Did you or anyone from your Department send a letter to Belmont Golf Club clarifying your letter or your Department’s letter to Belmont Golf Club dated 10 November 2004?
(6) If not, when will you or your Department retract the erroneous advice that has been given to the Belmont Golf Club?
(7) Did T D Kelly & Co, Solicitors for the Member for Wyong write to Mr K M Brown, Director of Liquor & Gaming on 26 May 2005 pointing out that his (Mr Brown as Director of Liquor & Gaming) intended inaction cannot confer a civil immunity on the directors of Belmont Golf Club absolving them from the discharge of their fiduciary duties?
(8) If Belmont Golf Club is relying on this erroneous advice from you or the Department of Gaming & Racing could this result in legal liabilities being incurred by persons acting on that advice and legal liabilities being incurred by your Department?
(9) Do you think it is appropriate that when an error occurs in one piece of correspondence from someone in your administration including yourself that it is clarified to all other recipients of correspondence from yourself or your administration who received the same or similar erroneous letters, in part or full?
What procedures and quality controls exist within your administration to ensure that when clarifying letters need to be sent by your administration that all recipients of the erroneous material receive the clarifying material?
(10) Were you informed as Minister for Gaming and Racing that your Department had made a mistake that resulted in you signing an incorrect letter?
(11) What is the authority for your guidelines mentioned in Mr Brown’s letter to T.D. Kelly & Co. Solicitors dated 17 November 2004?
(12) On what basis has it been determined by Mr K M Brown, the Director of Liquor & Gaming that the contractual arrangements between Belmont Golf Club and Kalayla Pty Ltd has “generally been for the benefit of members of the Club and supported by members”?
(13) Given that neither a valuation nor any financial analysis was undertaken let alone presented to members prior to the decision, how has Mr K M Brown, the Director of Liquor & Gaming determined that these contractual arrangements have “generally been for the benefit of members”?
