Legislation Review Committee

The Legislation Review Committee is a current joint statutory committee, established 8 May 2003, re-established 22 June 2011.

The Legislation Review Committee has two broad functions set out in section 8A and 9 of the Legislation Review Act 1987: to scrutinise all bills introduced to Parliament and all regulations subject to disallowance according to the criteria set out in those sections. The Bills scrutiny function under section 8A was enacted under the Legislation Review Amendment Act 2002. See:

The criteria in s.8A of the Legislation Review Act 1987 include (but are not limited) to whether a bill unduly trespasses on “personal rights and liberties”. The Committee’s information paper sets out the Committee’s understanding of the meaning and content of “personal rights and liberties”.

The Committee reports on its examination of Bills in the Legislation Review Digest.

The regulatory scrutiny function has been in operation since 1988, and between 1988 and 2002 the Committee operated as the Regulation Review Committee under the Regulation Review Act 1987. For information about the work of the former committee see the Regulation Review Committee.

      (2) Legislation Review Committee
      That:
      (1) In accordance with section 5 (1) (b) of the Legislation Review Act 1987, the following members of the Legislative Assembly be appointed to serve on the Legislation Review Committee: Mr Stephen Bromhead, Mr Garry Edwards, Mr John Flowers, Dr Geoff Lee and Ms Tania Mihailuk.
      (2) The Committee have leave to make visits of inspection within the State of New South Wales and other States and Territories of Australia.
      (3) A message be sent acquainting the Legislative Council of the resolution and requesting the Legislative Council to appoint three of its members to serve on the Committee.

      1. That under section 4 of the Legislation Review Act 1987, a joint committee known as the Legislation Review Committee be appointed.
      2. That under section 5 (1)(a) of the Act, Mr Peter Phelps, Mr Shaoquett Moselmane and Mr David Shoebridge be appointed to serve on the committee as members of the Legislative Council.
