    STATUTE LAW (MISCELLANEOUS PROVISIONS) BILL
Page: 1806

    Second Reading

    Debate resumed from 17 June.

Mr TINK (Epping) [12.40 p.m.]: The Statute Law (Miscellaneous Provisions) Bill makes minor and non-controversial amendments to various Acts of Parliament and continues the statute law revision program that has been established for some years. I have circulated the amendments among my Coalition colleagues and we have no problems with them. I take this opportunity to acknowledge Davina Langton and to thank her for her efforts. More importantly, I point out that Davina basically ran this place in the dying days of the last parliamentary session, when my old friend Mr Whelan was Leader of the House. I hope that Davina will play an increasing role in running the Premier's Department as I think it needs some help.

Mr GAUDRY (Newcastle—Parliamentary Secretary) [12.41 p.m.]: I thank the honourable member for Epping for his contribution to the debate and join him in paying tribute, as I am sure would every honourable member, to Davina Langton for her great work. I congratulate her on her promotion to the Premier's Department, where I am sure she will make a great contribution to the effectiveness of government in New South Wales. I commend the bill to the House.

    Motion agreed to.

    In Committee

Clauses 1 to 6 agreed to.

Schedules 1 and 2 agreed to.

    Schedule 3

Mr GAUDRY (Newcastle—Parliamentary Secretary) [12.42 p.m.], by leave: I move Government amendments Nos 1 and 2 in globo:

No. 1 Page 68, schedule 3, matter relating to Police Service Amendment (NSW Police) Act 2002. Omit "Whole Act". Insert instead "Section 4, Schedule 1 (except Schedule 1 [12]) and Schedule 2".

No. 2 Page 70, schedule 3, matter relating to Agricultural Industry Services Amendment (Interstate Arrangements) Act 2002. Omit "Whole Act". Insert instead "Section 4 and Schedule 1 (except Schedule 1 [6])".

Schedule 3 to the Statute Law (Miscellaneous Provisions) Bill repeals, among other things, a number of Acts and provisions of Acts that have commenced or that will not be commenced as they are no longer necessary. Schedule 3 repeals the whole of the Police Service Amendment (NSW Police) Act 2002 and the Agricultural Industries Services Amendment (Interstate Arrangements) Act 2002. However, it has been noted that both Acts contain provisions intended to commence at a later time that, therefore, need to be retained. The amendments will preserve these uncommenced sections along with certain formal parts of the Acts, such as their long titles.

The uncommenced provisions include schedule 1 [12] of the Police Service Amendment (NSW Police) Act 2002, which changes reference to the "Compensation Court" to the "District Court". This will commence upon proclamation of schedule 1.7 of the Compensation Court Repeal Act 2002. That Act abolishes the Compensation Court. Under the Act, schedule 1.7 will commence on 1 January 2004 unless proclaimed to commence on an earlier date. The remaining provisions that have not been commenced are section 5 and schedule 1 [6] of the Agricultural Industries Services Amendment (Interstate Arrangements) Act 2002. Section 5 repeals the Murray Valley Citrus Market Act 1989 and schedule 1 [6] inserts savings and transitional provisions consequent on the abolition of the Murray Valley Citrus Marketing Board, which was constituted by the repealed Act. Section 5 and schedule 1 [6] are due to commence on 1 July 2004 unless commenced sooner by proclamation. The amending Act specifically delayed commencement to allow time to finalise arrangements for a replacement industry body. I commend the amendments to the Committee.

    Amendments agreed to.

Schedule 3 as amended agreed to.

    Schedule 4 agreed to.

Bill reported from Committee with amendments and passed through remaining stages.
