*115 HUNTER DEVELOPMENTAL DISABILITY SERVICES___Mr Gaudry asked the Minister for Health Services Management representing the Minister for Health and Community Services___
          (1) Why has the Hunter Regional Administration of the Department of Community Services not been consulted with regard to restructuring of large residential facilities within the Hunter Developmental Disability Service?
          (2) Why, when there is evidence of severe overcrowding at the Stockton Centre, has a brand new 12-bed unit been left vacant and unfurnished for over 18 months?
          (3) Will there be a restructuring and deletion of Nursing Unit Manager positions within the Developmental Disability Service at the Stockton Centre?

          Answer___
          (1) The Department of Community Services will consult with all relevant senior management staff concerning the review of the management structure within all large developmental disability services residential centres.
          (2) Construction on the 12-bed unit has ceased as the operating budget for the Centre will not permit the Unit to be opened.
          (3) As indicated there will be a review of nursing management positions throughout all large residential centres within the developmental disability services, including Stockton Centre. The Review Committee will include a person with nursing qualifications and appropriate operational experience. The Health and Research Employees Association have been offered an opportunity to have an observer accompany the Review Committee.
          I would like to point out to members that between 1981 and 1991 the number of persons at Stockton has fallen from 793 to 500. 7 out of 21 wards have closed and 8 cottages have opened on campus.

*151 ZINCLINE AIR POLLUTION___Ms Allan asked the Minister for the Environment___
          (1) Is he aware of community concern about air pollution emanating from Zincline of Seven Hills?
          (2) What investigations have been conducted by the State Pollution Control Commission into Zincline?
          (3) What was the nature and results of these investigations?
          (4) If no investigations are in progress, will he undertake an environmental audit of Zincline?
          Answer___
          (1) Yes. I am advised by the Environment Protection Authority (EPA) that since 1 October 1991, two "Pollution Line" telephone complaints and one letter of complaint have been received by the former State Pollution Control Commission and the new EPA regarding air pollution emanating from the Zincline premises at 15 Powers Road, Seven Hills.

          The company operating at these premises is Transfield Constructions Pty Ltd. The complaints related to both the visible plume discharging periodically from the company's stacks and the settling of white dust on motor vehicles and structures in the area.
          (2) In response to the complaints, officers of the State Pollution Control Commission inspected the premises on 3 December 1991 and discussed pollution control requirements with company representatives. The site is operated primarily as a galvanising works. A fine white dust is emitted periodically from the galvanising process. Apart from the stacks used to disperse air pollution, no pollution control measures are in use at the premises. During the inspection, the Commission officers observed a plume of white particulate matter discharging from the company's stacks.
          (3) The EPA has served a Notice under section 23A of the Clean Air Act on Transfield Constructions Pty Ltd. The Notice requires:
            (a) the installation of stack emission sampling points in accordance with Appendix A of Schedule 2 of the Clean Air Regulations; and
            (b) the measurement of the rate of emission of particulates and acid gases from both the continuous galvanising units and the large galvanising baths.
          These tests are necessary to determine appropriate control measures. The results of the tests are to be reported to the EPA by 26 June 1992. Should the test results indicate unacceptable pollution levels, the company will be required to undertake control measures to minimise emissions.
          (4) Not applicable since environmental audit investigations, as outlined above, are already in progress.

          (1) Did the Ombudsman find, as a result of complaints made by a person between 1982 and 1984 against Detectives Hanrahan and Clark, that the Detectives had breached Rules 50 and 51 of the Rules made pursuant to the Police Regulation Act, in that they improperly divulged police information?
          (2) Is the Ombudsman currently enquiring into the activities of those officers and are his enquiries being impeded by police non-co-operation and appeals to the Supreme Court?

          (3) How much are these appeals costing taxpayers?
          (4) Did a person in 1985, during the currency of the first Ombudsman's inquiry, take Supreme Court action against Detective Peter Vincent, a person who worked with Detectives Hanrahan and Clark?
          (5) Did Detective Vincent, when a matter was finalised in 1989, agree to pay $60,000 in damages and costs and give an apology in open Court to the person who took action against him?
          (6) Did a person in 1985 take separate civil action in the Supreme Court during the currency of the Ombudsman's inquiry against Detective Clark?
          (7) Did Detective Clark, when a matter was settled in 1989, read a statement in open Court in which he stated that if any person believed he was referring to the person who complained about him when he had been talking of criminal activity in the gaming area, he wished to state unreservedly that such impression was unfounded?
          (8) Did a person take successful action against both the printed and electronic media as a result of media coverage and the police investigation by Detectives Hanrahan and Clark?
          (9) (a) Is he aware of the apologies read in the Supreme Court by the Task Force officers about the person who complained about them and that the charges originally preferred against the complaintant were deemed to be "offences unknown to the law"?
            (b) Why, therefore, are police continuing to pursue matters against the person who complained about Detectives Hanrahan and Clark?
          (10) (a) Was the person who complained against Detectives Hanrahan and Clark granted an Amusement Device Dealers Licence?
            (b) Later the same year, without any police objection, was the person granted a Poker Machine Dealer's Licence?
          (11) Did not the Court in the above instances regard such a person as a fit and proper person and a person of good character?

          Answer___
          The Acting Minister for Police and Emergency Services has advised:
          (1) The then New South Wales Ombudsman, Mr G. Masterman, found the complaint sustained. However, he made no recommendation that any disciplinary or other action be taken against either officer.
          Mr Masterman stated inter alia, "I believe that Sergeant Hanrahan and Detective Sergeant Clark were dedicated honest police officers. In all the circumstances I propose to recommend that no action should be taken against them."
          (2) No. The Ombudsman has disqualified himself in matters involving his former client, Mr Ainsworth.
          The Ombudsman has the full co-operation of the police concerned, who are entitled to lodge appeals to the Supreme Court in the same way as any other citizen.
          (3) Proceedings before the Supreme Court are costly. It would, however, be a denial of natural justice to block this avenue of appeal.
          (4) Yes.
          (5) Acting on legal advice, former Detective Vincent did make certain concessions. However, I am informed that the former Detective's defence was seriously handicapped because documentary material essential to his case was unavailable.
          (6) Yes.
          (7) I am advised that Detective Sergeant Clark did not read such a statement in open Court.
          (8) The NSW Police Service has not taken part in any civil actions which Mr Ainsworth may have instituted against the print or electronic media and, consequently, has no special knowledge or interest as to the outcome of such proceedings.
          (9) (a) Former Constable Vincent's apology in Court was in relation to enquiries he undertook after he left the Task Force and had been attached to the Licensing Investigation Section. His apology had nothing to do with the charges preferred by the Task Force.
              Mr Ainsworth and Mr Vibert were charged with two counts each of "Conspiracy to Obtain a Benefit by Deception", a common law offence.

              During the committal proceedings, Supreme Court summonses were served against Mr McKenzie, S.M., and Sergeant Hanrahan alleging that the charges were unknown at law and requesting a permanent stay of proceedings.
              The allegations set out in the summonses were heard by Mr Justice Cross in the Supreme Court, who held that the original charges were good at law and capable of being proved. At the completion of the committal proceedings the Magistrate found prima facie cases against Messrs Vibert and Ainsworth and charged Mr Vibert with four additional charges, two charges being common law offences of conspiracy and two being substantive offences of false pretences.
              Consequently, the Magistrate committed Mr Vibert for trial on six criminal offences. Further, the Magistrate charged Mr Ainsworth with two additional common law offences of conspiracy and committed him for trial on four criminal offences.
              Subsequent to the committal for trial, the Attorney General filed a no bill in relation to all of the charges for which Messrs Ainsworth and Vibert had been committed. The matters were then referred to the then Solicitor General, Ms Mary Gaudron, who filed a bill against Mr Vibert for a substantive offence under section 185 of the Crimes Act 1900. In addition, Ms Gaudron filed a bill against Mr Ainsworth for conspiracy based on the substantive charge against Mr Vibert.
              In May 1984, Mr Vibert stood trial and was convicted of the substantive offence. As a result of those proceedings a recommendation was made by Mr Jack Hiatt, Q.C., and the Crown Prosecutor at Mr Vibert's trial, that the charge against Mr Ainsworth be no billed. The charge was subsequently no billed.
              Mr Vibert lodged an appeal against his conviction and the Appeals Court held that the offence for which he was convicted was unknown at law and quashed the conviction. The offence in question was not contained in the original charges preferred by police.
              As the charge against Mr Ainsworth was no billed, its validity was never tested. Again, it was not one of the original charges preferred by police.
            (b) The only matters still being pursued against Mr Ainsworth are civil proceedings instituted against him by Senior Sergeant Hanrahan. The first trial was aborted at the conclusion of proceedings in 1990, when the Presiding Judge took ill and stood down. A new trial date has been set for

23 May 1992 and concerns charges of "abuse of process" and "defamation".
          (10) (a) Ainsworth Nominees Pty Ltd, of which Mr Ainsworth is the Chairman of Directors, was eventually granted both licences but it was not without police objection.
            (b) The police investigation of a subsequent application by the same company for a poker machine dealer's licence was limited to post-July 1986 activities, by direction, and subsequently granted by the court without police objection.
          (11) Ainsworth Nominees Pty Ltd was granted the licence. Mr Ainsworth was found to be a fit and proper person to be directly or indirectly interested in the application, the business and the profits of the business.

          (1) How many opal mining on-site camps have been ordered to be removed or dismantled in Lightning Ridge?
          (2) How many such camps have been forcibly bulldozed or otherwise removed?
          (3) How many such orders have been as a result of an order from the Mining Warden's Court or the Lightning Ridge Mining Registrar?
          (4) Have there been instances when the Lightning Ridge Mining Registrar has pre-empted court proceedings and ordered the removal of on-site camps?
          (5) What are the rules for Lightning Ridge opal mining on-site camps in regard to structure, size and general living standards?
          Answer___
          (1) One.

          (5) The following guidelines apply to the construction of improvements on claims. Any improvement (including a dwelling) must be in connection with the mining activities allowed under a claim. No improvements can be erected or constructed without the prior written approval of the Mining Registrar.
          Failure to obtain the approval of the Mining Registrar and/or to comply with the guidelines will be regarded as a breach of the conditions of the claim and could lead to its cancellation.
            (A) BUILDING CONSTRUCTIONS
            (i) The maximum enclosed area of a building cannot exceed 3 squares (i.e., 27 square metres).
              (ii) The total of any covered area cannot exceed 6 squares (i.e., 54 square metres).
              (iii) Adjoining buildings are regarded as one building even if they are on separate claims.
              (iv) Constructions made from or using brick, stone or mortar are not allowed.
              (v) Concrete slabs are not allowed.
              (vi) Extensions to existing buildings are allowed if they comply with these guidelines.
              (vii) Buildings may not be constructed within 200 metres of the town boundaries.
            (B) OTHER
              The following are allowed:
              (i) A caravan of any size.
              (ii) A tent of any size.
              (iii) A mobile home unit that can be transported by road without special permit or disassembly.
          If you do not understand these guidelines you should obtain advice from the Mining Registrar.

*249 LIGHTNING RIDGE OPAL CERTIFICATE OF CLAIM APPLICATIONS___ Mr Rogan asked the Minister for Natural Resources___
          (1) What has been the increase in charges for Lightning Ridge Opal Certificate of Claim applications for the 1989/90, 1991/92 financial years?
          (2) Is there now a landholder compensation component to these application fees?
          (3) What is the legal basis for the landholder compensation?

          (4) What is the amount of money per year paid to landholders as compensation as referred to above?
          (5) What has been the increase in opal mining prospecting licences for:
            (a) 1989/90?
            (b) 1990/91?
            (c) 1991/92 to date?
          Answer___
          (1) The fees payable for the registration of a claim and for the issue of an Opal Prospecting Licence are set out in the Regulations to the Mining Act 1973.
            (a) The fee for the registration of a claim was set at $25 on 30 June 1980 and has not changed since that date.
            (b) Provisions for Opal Prospecting licences were incorporated into the Mining Act 1973 on 29 August 1980 and the fee payable was set at $12.50. It was not changed until 1 June 1990 when it was increased to $150.
          (2) No.
          (3) Sections 120A and 121 of the Mining Act 1973 require the payment of compensation by holders of claims and holders of opal prospecting licences.
          (4) The Mining Act 1973 indicates that compensation may be the subject of an agreement between the landholder and holder of a claim or a licence or as may be assessed by the Warden.
          In July 1990 the Chief Mining Warden assessed compensation at $25 per claim of which half is paid to the affected landholder and the balance is paid into a fund. In respect of Opal Prospecting licences the Warden assessed compensation at $50 and $0.10 per hectare of the area affected of which $25 is paid into the fund and the balance to the landholder.
          Total repayments per year to landholders are difficult to determine as payments can be a matter of private treaty and there are instances where landholders waive their rights to receive compensation.

            (1) Parts of Jesmond and North Lambton have now been excluded from the Newcastle Mine Subsidence District because they have been identified as being not undermined and will never be undermined.
            At the time of the initial proclamation, there was little development between Bluegum Road, Jesmond, and the North Lambton Hill, so Bluegum Road was made the boundary because it is easily identified. In addition for parts of North Lambton,

    the Borehole Seam outcrops on the northern side of the Lambton Hill and some of the areas in the old district are actually below the coal seam horizon.
            Since the original proclamation, the Board's mapping resources have been expanded and together with the experience gained, it was decided that requiring property owners to seek approval from the Board before building, to prevent or at least mitigate future damage, is now not required for the areas which have been excluded.
            (2) Improvements which have now been excluded from the district are automatically covered for compensation. The owners are now relieved of the necessity to obtain the Board's approval prior to altering or erecting improvements.
            (3) I understand that the use of the term survey is relating to the accuracy of plans of mine workings.
            If a claim is received and the investigation reveals evidence of subsidence, damage which is consistent with mine subsidence and the cause of damage is not obviously something else, then if the Board needs further investigation by drilling, all investigation costs are met by the Board.
            (4) There are no existing claims against the Board for properties which have now been excluded from the Newcastle Mine Subsidence District.

              (1) to (3) Parts of Lambton, New Lambton and Kotara have now been excluded from the Newcastle Mine Subsidence District because they have been identified as being not undermined and will never be undermined.
              Since the original proclamation, the Board's mapping resources have been expanded and together with the experience gained, it was decided that requiring property owners to seek approval from the Board before building, to prevent or at least mitigate future damage, is now not required for the areas which have been excluded.
              (4) and (5) There are no existing claims against the Board for properties which have now been excluded from the Newcastle Mine Subsidence District.
              (6) Improvements which have now been excluded from the district are automatically covered for compensation. The owners are now relieved of the necessity to obtain the Board's approval prior to altering or erecting improvements.
              (7) If a claim is received and the investigation reveals evidence of subsidence, damage which is consistent with mine subsidence and the cause of damage is not obviously something else, then if the Board needs further investigation by drilling, all investigation costs are met by the Board.

              (2) Will he carry out an inquiry on the sale and what effects the sale has had on the leaseholders?
              (3) Is he going to approve the Valuer General's increase in land valuation and will he carry out an investigation of such a large increase as 308 per cent as compared to a general increase in the Auburn Municipality of 130 per cent?

              (1) When were the decibel readings taken, for the area surrounding the proposed toll gates from the F4 Freeway, Silverwater, that were less than 63 decibels?
              (2) In March 1991, were readings taken which showed noise levels far in excess of 63 decibels?
              (3) If so, why the discrepancy?
              (4) Will he give an undertaking to the people of Auburn that if the decibels have or will reach 67-68 that he will build soundproofing walls similar to those built on the F3 Freeway?
              (5) Will he now take new readings to determine what are the current sound decibels that affect the surrounding residential areas near the F4 tollgates at Silverwater?
              (6) On the week commencing 22 March 1992, did State Wide Roads, or any other organisation on behalf of the RTA, take pollution readings in the vicinity of the F4 Freeway tollgates?

              (3) Was an account sent to Mr Byatt's home instead of to his family and therefore, they only knew about his change of status on or about 15 March 1992?
              (4) (a) Was his brother-in-law, a Mr McMaster, abused by a social worker at Lidcombe Hospital when he made inquiries about the current status of his brother?
